General conditions of sale

1. Who we are

DUCCETTI since 1972 by Luciana Duccetti (“Duccetti”), whose data are shown in the footer of the site, is an active company that deals with design and realization entirely Made in Italy of beds, cushions for pets marked by the brand The Zazu (“Product/s”). Style, quality, accurate realization and maximum attention to the comfort and well-being of our animal friends are the main values underlying our production processes for the creation of products characterized by a unique design, can be purchased from the online catalogue of our e-commerce (“Shop online”) on the website www.thezazu.it.

2. To whom we address.

The Duccetti Online Shop is aimed exclusively at natural persons who act for purposes unrelated to their professional activity and who wish to pamper their pets with unique products for care, comfort and design (B2C sales channel, “Customer/i”). B. For any advice and information on the purchase, Duccetti invites the Customer to use the contact details indicated on the Site.

3. How our relationships are regulated. The applicable law.

Any purchase contract (“Contract/s“) concluded between the Customers and Duccetti through the Online Shop is governed by (i) these Terms, published and available on the Site and (ii) by the order placed on the Online Shop (“Order”), if and as confirmed by Duccetti (“Confirmation of Order”). B. The Conditions and the Contract are governed by Italian law, in particular the Italian Consumer Code (D.Lgs n. 206 of 06/09/2005 and subsequent amendments and additions), without prejudice to the application in favour of foreign Customers of any national law more favourable for the consumer.

4. Your personal data.

Duccetti processes the personal data of the Customers according to what is indicated in the Privacy Policy and the Cookie Policy available on the Site.

5. How to buy on our online shop.

A. In order to place an Order for the Products, the Customer: (i) selects the Products from those available and adds them to the virtual shopping cart, (ii) enters the data necessary for the shipment and delivery of the Products and for invoicing (if it requires the issuance of an invoice), (iii) pays the price (including taxes) in accordance with the available methods.

B. The Contract is concluded at the moment when the Customer receives the Order Confirmation, subject to the condition suspending the receipt of payment for the Products.

6. Price and payment.

A. The prices of the Products are indicated on the corresponding pages of the catalogue present on the Online Shop, net of shipping and delivery costs (which are quantified at the stage of processing the Order) The prices always include indirect taxes (if applicable) and packaging costs.

B. Any possible cost, charge, tax, tax, expense and/or disbursement that the country of destination of the Order should apply to the Products, in any capacity, and at the exclusive expense of the Customer.

C. The prices, the Products and/or their characteristics may be subject to updates and changes without prior notice. Such changes only apply to Orders not yet confirmed at the date of the change.

D. Payment for the Products may be made using the payment methods available on the Site.

7. The estimated shipping and delivery times of the Products.

A. Save different communication in the Order Confirmation, the shipment of the Products is made once payment has been received, normally within 7 (seven) working days, except for stops on public holidays and holiday periods.

B. In any case, the delivery times – or those indicated on the site and/ or communicated to the customer, however never exceeding the maximum terms provided by law for the protection of consumers – are indicative.

C. In the event that, following the Order Confirmation, some or all of the Products purchased by the Customer are not available, Duccetti will promptly inform the Customer and refund any amounts already paid, if possible using the same payment method chosen by the Customer.

8. What happens in case of loss and damage at delivery.

The risk of loss or damage to the Products during delivery transport is borne by Duccetti, pursuant to article 63, paragraph I, Consumer Code, except in the case where the carrier has been chosen directly by the Customer (Article 63, II paragraph, Consumer Code).

9. Our advice on the receipt of delivery.

Duccetti recommends that Customers always accept delivery “subject to verification” and promptly formalize any specific disputes on the number of packages and/ or the condition of the packaging, by contacting Duccetti at the addresses on the Site and attaching photographic documentation.

10. What is the right of withdrawal and how it is exercised.

The Customer can exercise the right of withdrawal (“Withdrawal”) from the purchase within 14 (fourteen) days from the delivery of the Products, sending a communication to Duccetti at info@thezazu.it indicating the order number and the Products for which you intend to exercise the Withdrawal, possibly attaching the Withdrawal form (Right of Withdrawal Form).

B. The Customer exercising the Withdrawal within the aforementioned period: (i) returns the Products within 14 (fourteen) days of notification of the Withdrawal, following the instructions provided by Duccetti; (ii) bears the full cost of returning the Products subject to the Withdrawal and (iii) returns the Products undamaged, in their original packaging, complete with packaging and documentation.

C. Duccetti, having verified that all the conditions and obligations set out above have been fulfilled, reimburses to the Customer the amount paid for the purchase of the Products subject to withdrawal within 14 (fourteen) days from receipt of the returned Products, if possible using the same payment method chosen by the Customer for the purchase.

D. The refund does not include (i) any additional costs attributable to the customer’s choice of a shipment other than the standard delivery method, by which we mean the cheapest in relation to the Products being shipped; or (II) any customs duties and any other sales tax paid by the Customer in addition to the Price of the Product. In the case of a single Order for more than one Product, the refund includes only the delivery costs relating to the/the Product/s subject to withdrawal which, unless otherwise indicated, are obtained by dividing the total amount of delivery costs by the number of Products.

11. Liability of the Customer for loss of value of the Product.

A. In case of withdrawal, the Customer is responsible for any decrease in the value of the Product that he intends to return that is due to the use and handling of the Product not necessary to establish its nature and characteristics. The Customer is also held responsible for any deterioration of the Products due to their incorrect handling and maintenance.

B. By way of example, mishandles the Product or the packaging if the Customer (i) removes the label from the Product, (ii) stains or damages the Product and/or (iii) washes it in a manner that is not in accordance with the instructions, (iv) damages the packaging. C. As a consequence of the above, Duccetti will refund to the Customer the Price paid less the amount equal to the depreciation suffered by the Product.

12. When Withdrawal is excluded.

As provided for by letter c) of article 59 of the Italian Consumer Code, withdrawal is excluded when the Product has been made to measure or has been subject to customization activities at the request of the Customer (For example, products with different colors or graphics from the standard ones, custom design, etc. ).

13. How long the warranty lasts and how it is exercised.

A. Duccetti ensures that the Products comply with applicable health, technical and safety regulations and standards, pursuant to Italian law and European Union law, and guarantees that the Products are free from defects of conformity and/or defects.

B. The conformity of the Products is guaranteed for a period of 2 (two) years from delivery, provided that, in any case, the action of the Customer directed to assert the defects of conformity of the Products is set forth in 26 (twenty-six) months from delivery, as provided for in Articles 128 and following of the Consumer Code.

C. These terms apply provided that this is possible and compatible with the nature of the Products, without prejudice to the provisions set out in subsequent articles 14 and 15 of the Conditions.

D. The Customer who wishes to assert a lack of conformity of the Products must notify it promptly to the e-mail address info@thezazu.it, attaching the documents necessary to prove the purchase and the existence of the defects of conformity reported.

E. Once the existence of the reported lack of conformity has been assessed, the Customer receives instructions for any remedy available pursuant to article 135a of the Consumer Code.

14. When the warranty is excluded or limited.

Any warranty in relation to defects of conformity and/or vices that may manifest themselves in relation to and due to improper use, not in accordance with the indications and instructions, including those provided by Duccetti in pre- and post-sale phases, or improper or otherwise negligent, imprudent and imperfect storage/maintenance, taking into account the nature and characteristics of the Products. In particular, the Customer acknowledges and accepts that the Products are susceptible to alterations that do not depend on Duccetti, such as those that may result from the washing methods carried out by the Customer.

15. What to do in case of disservices. Competent court.

A. Duccetti invites the Customers to communicate any disservice they believe they have suffered and, in any case, any dissatisfaction, to seek an amicable solution.

B. In case of any dispute, the Client may act out of court using the ODR platform established by Regulation (EU) n. 524/2013 and submit a complaint by filling in the electronic form available in the official languages of the European Union. In any case, for any dispute between the Customer and Duccetti is competent the place of residence or domicile of the consumer Customer.
